A letter of disclosure was designed to allow someone to be promoted into a position that they had relatives that would be under them and that they did not hire. So anyone who has a relative that they hired should not apply for a position that puts them in charge of them again. That was one of the main points made for adopting the ethics code. No one should be allowed to try and side step the original intent of what it was intended for. Their is more than one that in this position and it should not be allowed. My thought on this is not an attack on any one person but trying to manipulate the intent of the ethics rules for your own gain is an assault on your own character.
