ORDINANCE ESTABLISHING SPEED LIMIT

ORDAINED BY THE BOARD OF COMMISSIONERS OF HARRISON COUNTY, INDIANA THAT:
WHEREAS, the Board of Commissioners is the governing body of the County of Harrison in the State of Indiana, and
WHEREAS, in accordance with I.C. 36-1-3-6, a County may adopt an ordinance prescribing a specific manner for exercising a power, and
WHEREAS, in accordance with I.C. 9-21-5, a County may adopt a speed limit ordinance regulating speed to a safe driving level, and
WHEREAS, the Harrison County Commissioners have caused a traffic study to be made over and along Corydon Junction Road, and
WHEREAS, it is the duty of the Board of Commissioners of Harrison County to provide for the public safety of all citizens when traveling upon county roadways, and
WHEREAS, the Harrison County Commissioners have determined that it is in the best interest of the health, safety and general public traveling over and along Corydon Junction Road between Old State Road 64 and Lost Creek Road be regulated to a speed of thirty (30) miles per hour.
NOW THEREFORE BE IT ORDAINED by the governing body of Harrison County, Indiana that the maximum speed limit over and along Corydon Junction Road between Old State Road 64 and Lost Creek Road be regulated to a speed of thirty (30) miles per hour for all motor vehicles traveling along said roadway.
Violators of this Ordinance may be charged by a traffic summons issued by any police officer having traffic enforcement jurisdiction in the area and the county prosecuting attorney is authorized to prosecute the violation and the courts of Harrison County, Indiana having general traffic jurisdiction shall be empowered to process such charges as violations of law, as are all other speeding violations of the Indiana Code and like penalties shall be imposed.
EFFECTIVE DATE: This Ordinance shall become effective after passage by the Harrison County Commissioners and publication of this Ordinance as required by law.

Mulzer Crushed Stone, Inc., 534 Mozart Street, Tell City Indiana 47586, located near New Amsterdam, Harrison County, discharging to the Ohio River, is submitting a notice of Intent letter to notify the Indiana Department of Environmental Management of our intent to comply with the requirement under 327 IAC 15-12 to continue to discharge wastewater associated with sand, gravel, dimension stone, or crushed stone operations. Any person aggrieved by this action may appeal in writing to the Environmental Law Judge of the Office of Environmental Adjudication for an adjudicatory hearing on the question of whether this facility should operate under this NPDES general permit rule.  An appeal must be postmarked no later than 15 days from the date of this public notice.  Such a written request for an adjudicatory hearing must: (A) state the name and address of the person making a request; (B) identify the interest of the person making the request; (C) identify any persons represented by the person making the request; (D) state with particularity the reasons for the request; (E) state with particularity the issues proposed for consideration at the hearing; and (F) state with particularity the reasons why the NPDES general permit rule should not be available to the discharger identified in this notice.  Any such request shall be mailed or delivered to: Office of Environmental Adjudication, Indiana Government Center- North, 100 North Senate Avenue, Room 501, Indianapolis, Indiana 46204.
