All service charges for viewing are non-refundable.
The OWNER reserves the right to waive any informalities or to reject any and all bids. Award will be made to the low, responsive, responsible bidder. No proposal may be withdrawn after the scheduled closing time for receipt of bids for at least ninety (90) days. A conditional or qualified bid will not be accepted.
Each BIDDER must deposit with his bid, a certified check or acceptable bidder’s bond made payable to the owner, in a sum not less than five percent (5%) of the total amount of the bid. This check or bond will be held by the owner as evidence that the bidder will, if awarded the contract, enter into the same with the owner upon notification from him to do so within ten (10) days of said notification.
Contractor receiving award shall furnish an approved Performance Bond, Labor and Material Payment Bond in an amount at least equal to 100% of the contract amount and must be in full force and effect throughout the term of the construction project plus a period of twenty-four (24) months from the date of substantial completion. Bonds shall be furnished prior to notice to proceed of contract.
Each BIDDER must complete and submit with BID Indiana Form 96 inclusive of Non-Collusion Affidavit (furnished by Bidder) Standard Questionnaire and Financial Statement and other required documents as required by Indiana law.
A Pre-Bid Conference will be held on September 26, 2014 at 10:00 A.M. (Local Time) at the office of the Patoka Lake Regional Water and Sewer District, located at 2647 North S.R. 545, Dubois, IN 47527. Anyone considering bidding on this project is encouraged to attend.

PERFORMANCE EVALUATION REPORT

Notice is hereby given that the Indiana Office of Community & Rural Affairs, and the Indiana Housing and Community Development Authority will file their 2013 Combined Annual Performance Evaluation Report with the U.S. Department of Housing & Urban Development (HUD) on or about September 30, 2014. These programs are funded through the U.S. Department of Housing & Urban Development under Title I of the Housing & Community Development Act of 1974 as amended.
The Combined Annual Performance Evaluation Report provides information on the expenditure of activities with regard to the Community Development Block Grant (CDBG) Program, the Home Investment Partnership (HOME) Program, the Emergency Shelter Grant (ESG) Program, and the Housing Opportunities for Persons With AIDS (HOPWA) Program. The Office of Community & Rural Affairs will have the Combined Annual Performance Evaluation Report available for public inspection prior to its submission. NOTICE OF PUBLIC HEARING
The Patoka Lake Regional Water and Sewer District ("District") will hold a public hearing on October 13, 2014, at 6:30 p.m. at the District office board room, located at 2647 North State Road 545, Dubois, Indiana, regarding the issuance of the District's Waterworks Revenue Bonds of 2014 by the District in the aggregate principal amount not to exceed $13,000,000 ("Bonds"), to be used for the purpose of providing funds for the construction of improvements to the District's waterworks, including water system improvements, transmission main reinforcement, funding a reserve and capitalized interest for the Bonds, and to pay certain costs associated with the issuance of the Bonds, including underwriter's discount. If there are a sufficient amount of Bond proceeds available, the District will also fund one or more of the following: water storage tanks, booster station improvements and generator installation at the treatment plant.
The Bonds will be issued by the District pursuant to Indiana Code 13-26 and an ordinance to be adopted by the Board of Trustees of the District on October 13, 2014 ("Ordinance"). The Bonds are payable from Net Revenues (as defined in the Ordinance), on a parity with the District's outstanding Waterworks Refunding Revenue Bonds of 2008, Waterworks Refunding Revenue Bonds of 2012, Series A and Series B, and Waterworks Revenue Bonds of 2013, and senior to the payment of the District's Junior Taxable Waterworks Revenue Bonds of 2010. The Bonds will mature no later than January 1, 2040.
The public hearing is being held pursuant to Section 147(f) of the Internal Revenue Code of 1986, as amended. The public is invited to attend and comment on any of the matters herein noted. Written comments may also be submitted to the Secretary of the District until 6:30 p.m. on October 13, 2014, by delivering such comments to the District's office, 2647 North State Road 545, Dubois, Indiana 47527.

TOWN OF LANESVILLE ORDINANCE NO. 01-2014-02
REPLACING ORDINANCE NO. 01-2010-02
AN ORDINANCE TO PROHIBIT NUISANCES WITHIN
THE TOWN OF LANESVILLE, HARRISON COUNTY, INDIANA

WHEREAS, the Town Council of the Town of Lanesville, Harrison County desires to promote the health and well-being of its citizens, and
WHEREAS, the Town Council of the Town of Lanesville, Harrison County has determined that it necessary and prudent to determine what conditions or actions are public nuisances within the Town of Lanesville, Harrison County, Indiana, and
WHEREAS, the Town Council of the Town of Lanesville, Harrison County, Indiana shall define, prohibit and enforce nuisances within the Town of Lanesville, Harrison County, Indiana,
NOW THEREFORE, BE IT ORDAINED  BY THE Town Council of Lanesville as follows:
1. PUBLIC NUISANCES PROHIBITED
A. No person or business shall erect, contrive, cause, continue, maintain or permit to exist any public
nuisance within the Town of Lanesville, Indiana.
B. An agricultural operation or any of its appurtenances is not and does not become a nuisance, private
or public, by any changed conditions in the vicinity of the locality after the agricultural operation has
been in operation continuously for more than one (1) year if there is no significant change in the hours
of operation, there is no significant change in the types of operation, and the operation would not
have been a nuisance at the time the agricultural operation began on that locality.
2. PUBLIC NUISANCE DEFINED
A public nuisance is a thing, act, occupation, condition or use of property which shall continue for such length
of time as to:
A. Substantially annoy, injure or endanger the comfort, health, repose or safety of the public; or
B. In any way render the public insecure in life, health, or enjoyment in the use of property. C. Greatly offend the public morals or decency; or
D. Unlawfully and substantially interfere with, obstruct or tend to obstruct or render dangerous for
passage any street, alley, sidewalk, highway, body of water or any other public way; or
E. Is injurious to health, or indecent, or offensive to the senses, or an obstruction to the full use of
property so as to interfere with the comfortable enjoyment of life or property;
3. PUBLIC HEALTH NUISANCES
The following acts, omissions, places, conditions and things are specifically declared to be a public health
nuisance, but shall not be construed to exclude other health nuisances as defined by the Indiana Code.
A. Carcasses of animals not buried or otherwise disposed of in a sanitary manner within 24 hours of
the animals death;
B. Accumulations of decayed animal or vegetable matter, trash, rubbish, rotting lumber, bedding,
packing material, newspapers, junk vehicles, scrap metal or any material which flies, mosquitoes,
disease-carrying insects, rats or other vermin may breed, or be a fire hazard;
C. Any and all stagnant water in which mosquitoes, flies or other insects can multiply; D. Garbage cans which are not sealed or clean;
E. The escape of smoke, soot, cinders noxious acids or fumes, gasses, fly ash or dust within the Town
limits in such quantities as to endanger the health of persons or threaten or cause injury to property;
F. The pollution of any public well or cistern, stream or body of water by sewage, wastes of any, kind
or other substances;
G. Any use of property, substances or things within the town limits emitting or causing foul, offensive,
noisy, nauseous, noxious or disagreeable odors, effluvia or stenches repulsive to the physical
senses of persons which annoy, discomfort, injure or inconvenience the health of a person or any
appreciable number of persons within the Town;
H. All abandoned wells not securely covered or secured from public use or access;
I. Weeds;
J. Any accumulation of junk, rubbish, scrap metal, automotive parts, building materials, inoperable
machinery, dead trees or parts thereof, upon any premises in a residential area;
4. JUNK CARS AND JUNK
A. The word “junk” used in this section shall mean any articles in any form composed of or consisting of
any of the following enumerated discarded, abandoned or cast-off metals or materials, namely iron,
brass, steel, copper, tin, lead or any other materials or compounds thereof, broken glass, rags,
clothing, rubber, used tires, plastics and synthetic substances and fabrics, bottles, papers or any
other waste material or any compound or by-product of the foregoing enumerated materials; Junk
shall also include and mean abandoned, inoperable, wrecked or dismantled vehicles or parts
thereof.
B. A junk car shall mean any motor vehicle which does not bear a currently valid license plate and
which is not stored in a garage or building.
5. JUNK AND JUNK CARS DECLARED NUISANCES
Because of the danger of health by vermin and insects and because of the danger of the safety of children
attracted by junk or junk cars, abandoned and junk cars not complying with Section 4 above, are declared to
be nuisances except in lawfully operated junk yards.
6. STORAGE PROHIBITED
It shall be unlawful for any person to store or allow to remain in the open upon public or private property within
the Town, any disassembled and/or non-operative and unlicensed, or junked, wrecked or abandoned motor
vehicle for a period of ten (10) days or more on public property or a period of fifteen (15) days on private
property unless the storage is in connection with an automobile sale or repair business.
7. VIOLATION OF ORDINANCE
Nuisances are prohibited in the Town of Lanesville and the existence of which shall constitute a violation of the
Ordinance subjecting the landowner to a civil fine of fifty dollars ($50).  Each day a violation continues after
receipt of a notice of violation shall constitute a separate offense.  The civil fine shall be in addition to the cost
collection procedures set forth in Indiana Code 36-7-10.1-4.
8. NOTICE OF VIOLATION
Upon receipt of the complaint that a violation of this Ordinance exists, the Lanesville Clerk-Treasurer shall
issue a ten (10) day written notice to remove nuisance(s) which shall be served by the Lanesville Police
Department upon the landowner, if that landowner is a resident of the Town of Lanesville, or by certified mail
addressed to last known address, if landowner is a non-resident of the Town of Lanesville.
9.  CITATIONS AND FINES
If a disassembled and/or non-operative and unlicensed, or junked, wrecked or abandoned motor vehicle
remains in the open upon public or private property within the Town over the ten (10) day written notice
period, the owner will be fined $100 and given another citation to remove within seven (7) days.
If the nuisance is not removed within the second seven (7) day period the owner will be fined $200.  For
every seven day period the fine will increase $100.
This ordinance becomes effective immediately and must be published in The Corydon Democrat at least one
(1) time within thirty (30) days after its effective date. ADOPTED this 8th day of September, 2014.
